Evidence leaders at the Madlanga Commission of Inquiry have applied for parts of former Crime Intelligence deputy head Major-General Feroz Khan’s evidence to be heard in camera.
The application concerns certain WhatsApp communications and documents involving Khan that are expected to form part of his testimony before the commission.
If granted, Khan’s legal representatives will be allowed to attend the closed proceedings and disclose the contents to him so that they can obtain his instructions.
The media has been given 72 hours to oppose the application.
The commission is also seeking confidentiality around the in-camera proceedings, including the recordings and documents presented during the closed session.
Khan is scheduled to return to the commission on Monday, 28 September.
Meanwhile, the South African Police Service (SAPS) dismissed Khan with immediate effect earlier this month.
He had faced disciplinary proceedings over allegations that his conduct brought the police service into disrepute.
The commission previously heard that Khan had been described as an “outlier” after concerns were raised about his external remunerative work.
Public Service Commission Chairperson Somadoda Fikeni told the inquiry that the PSC identified concerns while verifying financial disclosures submitted by senior SAPS management.
According to evidence presented to the commission, Khan earned approximately R3 million a year from external remunerative work.
The latest application comes as the commission continues to examine evidence relating to governance, accountability and conduct within the police service.
