Court Set to Rule on Bail Bid of Former SAPS Task Force Member Accused of Witness D Murder

The Brakpan Magistrate’s Court is expected to hand down judgment on Monday in the bail application of Matipandile Sotheni, a former South African Police Service (SAPS) Special Task Force member accused of murdering Marius van der Merwe, widely known as Witness D before the Madlanga Commission.

Sotheni is facing 16 charges relating to Van der Merwe’s murder and other associated offences.

The State has opposed his release on bail, arguing that he poses a flight risk and may interfere with witnesses if allowed back into the community.

During the bail proceedings, Sotheni maintained his innocence, denying any involvement in the killing. Through his legal representatives, he told the court that he intends to stand trial and clear his name.

His defence argued that Van der Merwe’s testimony before the Madlanga Commission did not implicate Sotheni in any wrongdoing, and therefore there was no apparent motive for him to have planned or participated in the murder.

However, the prosecution contended that evidence gathered during the investigation, including Sotheni’s alleged close association with the late Wiandre Pretorius, places him at the centre of a broader conspiracy linked to Van der Merwe’s death.

The court’s decision on whether Sotheni will remain behind bars pending trial is expected to be closely watched as investigations into the high-profile case continue.
