Legal representatives for Fadiel Adams say the National Coloured Congress (NCC) leader is likely to appear in court on Thursday, as he has not yet been formally charged.

Adams was arrested on Tuesday by the Political Killings Task Team and is believed to be in transit to KwaZulu-Natal. He is facing allegations of fraud and defeating the ends of justice in connection with the murder of Sindiso Magaqa.

Earlier reports suggested Adams would appear in a Durban court on Wednesday. However, his attorney, Bruce Hendricks, said the legal team is still uncertain of his exact location.

“We don’t know where he is. We have a team in Durban waiting at various police stations, but we are not aware of where Mr Adams is currently,” Hendricks said.

He added that Adams was taken from his parliamentary residence and transported in a police vehicle, but has not yet been formally processed. According to Hendricks, Adams has been issued with a SAP 14A notice, which outlines his constitutional rights, but the formal charging process is still outstanding.

“He must still be processed in terms of the case docket, where he will be formally informed of the charges before appearing in court,” Hendricks explained.

He indicated that unless the process is completed swiftly, Adams is more likely to make his first court appearance on Thursday.
