North West businessman Brown Mogotsi has applied for the recusal of the chief evidence leader at the Madlanga Commission, halting his scheduled testimony this week.

Mogotsi was expected to continue giving evidence but has instead accused evidence leader Matthew Chaskalson of unfair treatment.

He claims Chaskalson adopted an aggressive approach during proceedings and introduced evidence that had not been disclosed to him in advance.

In response, commission spokesperson Jeremy Michaels said Chaskalson intends to seek permission from his professional bodies to file an affidavit addressing the allegations.

“The commission will hear Mr Mogotsi’s recusal application on 15 May, after which his testimony will proceed depending on the outcome either led by Advocate Chaskalson or another evidence leader,” Michaels said.

Proceedings are expected to resume once the commission has ruled on the application.
