The Economic Freedom Fighters (EFF) have welcomed the Constitutional Court's decision to dismiss AfriForum’s application for leave to appeal a ruling that found the "Kill the Boer" chant does not constitute hate speech.

The party criticized AfriForum’s legal challenge as a "frivolous and cynical attempt" to use the courts to silence black resistance. EFF leader Julius Malema has continued to chant the song, most recently at the party’s Human Rights Day event in Sharpeville, Gauteng.

EFF National Spokesperson Thembi Msane said the party remains steadfast in its stance.

"The EFF has always been clear—we will not be intimidated, silenced, or censored by racists who refuse to acknowledge the sins of their past. The liberation struggle belongs to us, and no court, lobby group, or reactionary force will erase our history or dictate how we remember our struggle. The Constitutional Court ruling is a victory for truth, historical justice, and the freedom to commemorate our fight against oppression," said Msane.
