The case against a couple accused of manufacturing and distributing child pornography is set to resume today at the Randburg Magistrate’s Court, north of Johannesburg.

Darren Wilken and his girlfriend face multiple charges, including 24 counts of money laundering, possession and distribution of child pornography, and contravention of the Drug Trafficking Act.

The case was postponed over a week ago due to a legal dispute regarding whether the offences should be classified under Schedule One or Schedule Five of the Criminal Procedure Act.

National Prosecuting Authority (NPA) spokesperson Phindi Mjonondwane explained the delay, stating, “The defence argues these are Schedule One offences, while the State insists they fall under Schedule Five. We have requested a postponement to obtain a certificate from the Office of the Director for Public Prosecution confirming the schedule. Additionally, we received the address of accused number one and need time to verify it.”

The case continues to unfold as legal proceedings move forward.
