IEC vs MK party in ConCourt showdown ahead of May elections

The Electoral Commission (IEC) and the uMkhonto we Sizwe (MK) party will have their final showdown in the Constitutional Court before the May elections.

The court is tasked with clarifying former President Jacob Zuma’s eligibility to stand for public office by interpreting Section 47(1)(E) of the Constitution, which will impact future elections.

Retired Constitutional Court Judge Sisi Khampepe emphasized the importance of upholding the rule of law and justice in Mr. Zuma's case.

Zuma's 15-month sentence for contempt of court in June 2021 led to challenges and subsequent disqualification of his candidacy, though he successfully appealed this decision in the Electoral Court.

The IEC sought clarification from the Constitutional Court on the matter due to its constitutional implications.

The Council for the Advancement of the South African Constitution (CASAC) is also involved, arguing for the separation of powers principle.

The apex court's decision will bring finality to Zuma's eligibility before any votes are cast.
