Court considers bid to separate trial in AKA and Tibz murder case

Plea proceedings are continuing in the Durban High Court in the case against seven men accused of the murders of rapper Kiernan “AKA” Forbes and entrepreneur Tebello “Tibz” Motsoane.

The pair were shot and killed on Florida Road in Durban more than three years ago.

State Prosecutor Lawrence Gcaba is currently putting the charges to the accused in Court W.

Proceedings were briefly delayed after an application to separate the trial of six of the accused from that of accused number three, Siyanda Myeza, was raised.

Lindokuhle Mkhwanazi, supported by five co-accused, wants the court to hear their cases separately from Myeza’s.

Mkhwanazi’s lawyer, Simphiwe Mlotswa, asked for the matter to be postponed to Tuesday to allow the court sufficient time to consider the separation application.

However, Gcaba argued that there was no reason for the charges against all seven accused not to be formally put to them while the application is being considered.

The group faces the first 11 charges, including murder and attempted murder.

Myeza faces an additional five charges, including murder and the theft of a motor vehicle.

The court is expected to consider the application as plea proceedings continue.
