The Gauteng High Court in Pretoria has dismissed businessman Hangwani Maumela’s urgent application to prevent the sale of his Ferrari SF90 Stradale, valued at at least R9.5 million.
Maumela and the trustees of the MHR Maumela Family Trust approached the court in an effort to stop the luxury vehicle from being sold.
The Ferrari is among several assets preserved by the Special Tribunal as part of a Special Investigating Unit (SIU) probe into alleged corruption and maladministration at Tembisa Hospital.
The investigation relates to allegations that about R2 billion was looted from the hospital.
The High Court found that the Special Tribunal’s order allowing the sale of the vehicle was an interim order and was therefore not automatically suspended by the appeal process.
The court ruled that Maumela and the trust had failed to establish a clear legal right to prevent the sale of the Ferrari.
It also found that they had not demonstrated reasonable prospects of success in their appeal or shown that they would suffer irreparable harm if the vehicle was sold.
The court subsequently ordered the trustees of the MHR Maumela Family Trust, acting in their representative capacities, to pay the costs of the urgent application.
