The Constitutional Court of South Africa is set to hear an application on Tuesday brought by the Board of Healthcare Funders, which is challenging the legislative process that led to the adoption of the National Health Insurance Act.
The Act, signed into law in 2023, aims to establish universal healthcare coverage for all South Africans and ensure access to quality medical services through a centralised funding system.
However, the Board of Healthcare Funders argues that Parliament failed to fulfil its constitutional obligation to facilitate meaningful public participation before the legislation was passed.
The organisation is asking the court to declare the Act invalid and set it aside, citing procedural flaws in its adoption.
The case is expected to draw significant attention, as the NHI remains one of the most debated policy reforms in South Africa’s healthcare sector.
