Bloemfontein Magistrate’s Court Dismisses Charges Against SAPS Whistleblowers

The Bloemfontein Magistrate’s Court has dismissed harassment and defamation charges against SAPS whistleblowers Patricia Morgan-Mashale and her husband, George Mashale. The charges were brought forward after Deputy Provincial Police Commissioner Major General Solly Lesia accused the couple of violating a Harassment Order related to WhatsApp messages.

Magistrate Lucky Mukatuni concluded that the prosecution’s case was based on hearsay and lacked substantial evidence. The proceedings, which began in August 2023, stretched over nearly a year.

George Mashale expressed mixed feelings about the verdict. “It’s a relief, but also a bittersweet moment,” he said. “I’ve been waiting for this for so long and finally feel vindicated. The court found there was no crime, no charges, nothing. We were dragged to court due to individuals misusing state resources and abusing their power, thinking they are above the law.”

Patricia Morgan-Mashale had gone into hiding in 2022 following threats against her after she reported suspicious activities by senior police officials, including issues related to procedural promotions and appointments.

Morgan-Mashale criticized the treatment of whistleblowers, stating, “I am being maliciously prosecuted. Some whistleblowers have been killed, and the country is not prioritizing their protection. After this case, I plan to consult with my lawyers about approaching the International Criminal Court.”
